Flood Protection Management Bylaw 2012

The Otago Regional Council Flood Protection Management Bylaw become operative on 1 September 2012. This Bylaw replaced the Flood Protection Management Bylaw 2008.

If you want to carry out an activity near an Otago Regional Council flood protection scheme, you must comply with the Bylaw.

 

Purpose of the Bylaw

This Bylaw was developed under the Local Government Act (LGA 2002) to protect our community flood protection infrastructure.

The Bylaw aims to manage, regulate and protect flood protection works belonging to, or under the control of Otago Regional Council. Flood protection works can include drains, overland flow paths, defences against water, floodways, groynes, cross-banks, anchored tree protection and plantings as mapped in the Bylaw.

 

Bylaw fees

When applying to carry out an activity near a flood protection scheme a deposit of $300 is to be paid with your application, and as appropriate, additional costs be invoiced, or refunds made to reflect the actual costs.

 

Area covered by the Bylaw

The areas that the Bylaw applies to are:

  • Lower Clutha
  • Tokomairiro
  • Lower, East and West Taieri
  • Leith Lindsay
  • Hilderthorpe
  • Waitaki
  • Alexandra

Why you should read the Bylaw

If you're thinking of carrying out an activity in Otago near an Otago Regional Council flood protection scheme you should read the Bylaw to see if you need written approval from us.

You will also need to comply with the rules in the Otago Water Plan and Coast Plan, which control any adverse effects on the environment from the activity.
