Proposed Plan Change 6AA

Otago Regional Council (ORC) is proposing a plan change to postpone the date when certain rules controlling discharge contaminant concentration and rules on nitrogen leaching come into force, from 1 April 2020 to 1 April 2026.

Proposed Plan Change 6AA is the first of two plan changes that will address significant issues with the Water Plan and strengthen the plan’s existing policy framework, in advance of developing a comprehensive plan review. It is expected that the full review of the Water Plan will be completed, and new planning provisions will be operative, before 1 April 2026.

Proposed Plan Change 6AA was notified by ORC on Saturday 5 October 2019, in accordance with Clause 5 of Schedule 1 to the RMA. ORC also prepared a Section 32 evaluation report outlining the rationale for the changes proposed under Proposed Plan Change 6AA. As the proposed plan change relates to water, the amendments to rules in proposed Plan Change 6AA will take immediate legal effect from the date of notification, pursuant to section 86B(1)(a) and (3) of the Resource Management Act 1991.

Submissions closed at 5pm on 4 November 2019.

Council released the Summary of Decisions Requested on Plan Change 6AA and called for further submission on Saturday 9 November 2019.

Important Information:

Under Clause 8, Schedule 1 of the Resource Management Act 1991, you may make a further submission if you are:

(a) A person representing a relevant aspect of the public interest; or

(b) A person that has an interest in the proposed plan change greater than the interest that the general public has.

A further submission may only be made in support of, or in opposition to an original submission. A further submission must state whether you support or oppose an original submission (or part thereof) and whether or not you wish to be heard on your further submission. A copy of your further submission must be served on the original submitter to which your further submission relates, within five working days of making your further submission to the Otago Regional Council.

  2. Address any appeals to the Environment Court
  3. Plan change becomes operative
