Proposed Plan Change 6AA

Otago Regional Council (ORC) is proposing a plan change to postpone the date when certain rules controlling discharge contaminant concentration and rules on nitrogen leaching come into force, from 1 April 2020 to 1 April 2026.

Proposed Plan Change 6AA is the first of two plan changes that will address significant issues with the Water Plan and strengthen the plan’s existing policy framework, in advance of developing a comprehensive plan review. It is expected that the full review of the Water Plan will be completed, and new planning provisions will be operative, before 1 April 2026.

Notification and submissions

Proposed Plan Change 6AA was notified by ORC on 5 October 2019, in accordance with Clause 5 of Schedule 1 to the RMA, and the period for submissions closed on 4 November 2019.

A total of 20 submissions were received.

Council released the Summary of Decisions Requested (see below) and called for further submissions on 9 November 2019.  Three further submissions were received.

The Section 42A report, which seeks to assist the decision-making process by summarising the main matters raised in submissions and further submissions and identifies key questions which the Hearing Commissioner must consider in order to make his recommendations to the ORC, was released on 11 December 2019 (see below). 

A hearing was held in Dunedin on 18 and 19 December 2019. 


Decisions of Council

Council released its decisions on Saturday 8 February 2020.

Any person who has made a submission has the right to appeal the council’s decisions to the Environment Court (under clause 14 of the First Schedule of the RMA). Appeals close 30 working days after service of the notice of decision.

Any such appeal must be in the prescribed form. A copy of the notice of appeal must be sent to the Otago Regional Council and to every person who made a submission on the appealed provision or matter.
